Legal expenses insurance: which areas you really need

A dispute with your employer, your landlord or after an accident can be expensive. Here you can read how legal expenses insurance (Rechtsschutzversicherung) is structured, what it pays and where its limits are.

What the insurance pays

If it comes to a legal dispute, legal expenses insurance covers, depending on the policy, the costs of your lawyer, the court, experts and witnesses. If you lose the case, it also pays the other side’s legal fees to the extent that you have to reimburse them. The insurer must first confirm that it will cover the costs. It does not pay administrative fines or criminal fines.

The most important modules

You put your cover together from modules. The most common are:

  • Private: disputes arising from everyday contracts, for example over a purchase or with a tradesperson, and claims for compensation.
  • Employment: disputes with your employer, for example about a dismissal or a job reference.
  • Traffic: disputes after an accident, about a car or over a fine notice, as a driver, cyclist, pedestrian or passenger.
  • Housing: disputes with your landlord, tenant or neighbour.

There are separate modules for the professional activities of self-employed people.

Waiting periods and disputes from before the policy

For many areas a waiting period applies after you take out the policy, usually three months, sometimes longer in employment law. After an accident and in traffic fine or criminal proceedings, cover usually applies immediately. For disputes arising from contracts, for example when buying a car or with a garage, many tariffs also have a waiting period.

Important: if the event that triggered the dispute happened before the policy started or during the waiting period, the insurer will usually not pay. So take out legal expenses insurance before there is trouble.

What is usually not covered

  • divorce and court disputes in family and inheritance law; often only an initial consultation is covered,
  • building a house, buying land and construction financing,
  • disputes over speculative investments,
  • defence against the accusation of a serious crime (Verbrechen); if you are convicted of an intentional offence, you usually have to repay the costs.

If you cause damage to someone else and are asked to pay for it, you need liability insurance (Haftpflichtversicherung). Legal expenses insurance, on the other hand, helps you enforce your own claims.

How I can help

Together we will look at which areas matter to you, depending on whether you are, for example, an employee, a tenant or a driver, and I will show you the suitable cover from SIGNAL IDUNA. I am happy to look at your existing policies to spot gaps. Please note: I advise on insurance, not on your legal case. That is what a lawyer is for.

This article gives a general overview. Exactly what is covered is set out in the terms and conditions of the plan. I am a tied insurance agent (gebundener Versicherungsvertreter) and exclusively arrange products of the SIGNAL IDUNA Group.
